AN ACT MAKING AN APPROPRIATION TO THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION FOR THE PURPOSE OF INSTALLING CROSSING PROTECTIVE DEVICES AT HIGHWAY-RELATED GRADE CROSSINGS FOR THE FISCAL YEAR 2000.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following sum, or so much of it as may be necessary, is appropriated out of any money in the State General Fund not otherwise appropriated, to the Mississippi Department of Transportation for the purpose of installing crossing protective devices at highway-railroad grade crossings for the fiscal year beginning July 1, 1999, and ending June 30, 2000

$3,000,000.00.

SECTION 2. (1) The money appropriated in Section 1 of this act shall be used only to install crossing protective devices at highway-railroad grade crossings in cities with populations not less than fifty thousand (50,000) according to the latest federal decennial census.

(2) The money shall be expended as follows:

(a) The Mississippi Department of Transportation shall pay one hundred percent (100%) of the cost of the installation of the crossing protective devices; or

(b) If a city pays up to ten percent (10%) or a private entity pays up to ten percent (10%) or each pay up to ten percent (10%) of the cost of the installation of the crossing protective devices, then the Mississippi Department of Transportation shall pay the remainder of the cost.

SECTION 3. The money appropriated by this act shall be paid by the State Treasurer out of any money in the State General Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

SECTION 4. This act shall take effect and be in force from and after July 1, 1999.
